Rugby star Gareth Thomas has admitted he did not tell a former partner he was HIV positive when he started a relationship, High Court documents show.

His ex, Ian Baum, accused Mr Thomas, 48, of “hiding” he was HIV positive and “not taking proper care” before passing the virus on to him when they were a couple.

Former Wales captain Mr Thomas has now admitted he did not tell Mr Baum he was HIV positive when the couple began dating in October 2013.

He denies passing HIV to Mr. Baum or controlling and forcing it in their relationship.

HIV carriers can be charged with grievous bodily harm if they fail to disclose their medical condition to potential partners and then pass on the infection.

Mr Thomas denies he ‘lied’ about his HIV-positive condition because he was never asked about it by Mr Baum, 59.

He also said they didn’t have sex for four months after they met because he “received an injury.”

But he admitted he was “wrong” to believe then he could not pass the condition on to others, which his lawyers said was “a genuine belief at the relevant time”.

In a case set to go before the High Court, Mr Thomas is being charged by Mr Baum with “assault, assault, willful injury and negligence”.

Mr Baum is demanding damages of at least £150,000, although it could be significantly higher for “serious physical and psychological injuries” and a “resulting loss of life expectancy of around six to eight years”.

The retired rugby star claims he and Mr Baum only had sex after Mr Baum announced he was HIV positive in 2014 and Mr Thomas did the same.

In High Court documents filed last week, Mr Thomas’ lawyers allege that Mr Baum was “a bit blase” about contracting HIV, “his attitude was that sooner or later he was going to get HIV”. But they add: “The plaintiff is admitted [Mr Baum] did not expressly consent to the risk of HIV transmission by the defendant.’

Mr Thomas said Mr Baum had been “promiscuous” during their relationship, although evidence of this is “to be determined”. Mr Baum claims he was monogamous when they were together.

The allegations against Mr Thomas, which span the period between 2013 and 2018, came before he revealed in a 2019 interview and BBC documentary that he had HIV.

He came out as gay in 2009, towards the end of a remarkable career which included 100 caps for Wales, and has been hailed as a pioneer in LGBTQ sport.
